Terms of Service

These Terms of Service ("Terms") govern your use of the Pimstone Performance website at pimstoneperformance.com, the program-fit quiz, and any related content, communities, and services we provide (together, the "Services"). By accessing or using the Services you agree to these Terms and to our Privacy Notice. If you do not agree, do not use the Services.

Who we are

Pimstone Performance ("we", "us", or "our") provides vertical-jump and athletic-performance training programs, educational content, and a free online community for athletes. Questions about these Terms can be sent to @pimstoneperformance on Instagram.

Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may only use the Services and purchase a program with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.

The program-fit quiz

The quiz asks about your sport, estimated vertical-jump range, goals, training needs, and contact information so we can show you a program-fit result and follow up about the training program. You agree to provide accurate information and to submit only your own details. Your quiz result is general guidance about program fit and is not a promise of specific results.

Purchases and third-party platforms

Training programs are sold and delivered through TrainHeroic, and our free community is hosted on Skool. When you continue to either platform you leave our website, and that platform's own terms, privacy practices, billing, and refund policies apply to your purchase, subscription, and account. We do not process payments or store payment information on this website. Prices and program details shown on our site may change without notice, and the price on the checkout page controls.

Health and safety disclaimer

Our programs and content involve physical exercise, including plyometric, strength, and jump training, which carry an inherent risk of injury. The Services are provided for general educational and training purposes only and are not medical advice. Consult a physician or qualified health professional before beginning any training program, especially if you have an injury, medical condition, or are unsure about your ability to train safely. You are responsible for training within your own limits, using appropriate equipment and surfaces, and stopping if you feel pain or discomfort. You assume all risk arising from your participation.

No guarantee of results

Vertical-jump gains, athletic results, and testimonials shown on the Services reflect individual experiences and are not typical or guaranteed. Your results depend on many factors, including your starting point, consistency, effort, nutrition, recovery, and genetics.

Intellectual property

The Services, including program content, training plans, videos, text, graphics, logos, and the Pimstone Performance name, are owned by Pimstone Performance or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, revocable license to use the content for your own training. You may not copy, resell, redistribute, share account access, or create derivative works from our programs or content without our written permission.

Acceptable use

You agree not to use the Services in any way that is unlawful, harmful, or interferes with the Services or anyone's use of them. This includes submitting false or misleading information, attempting to access data that is not yours, scraping or automating access without permission, uploading malicious code, or harassing other members in our community.

Community and social content

We share training content on social platforms such as Instagram, TikTok, and YouTube, and may use platform tools and analytics to understand how that content performs. Your use of those platforms is governed by their own terms. If you post content in our community or tag us, you grant us a non-exclusive, royalty-free license to display and share that content in connection with the Services, and you confirm you have the right to grant that license.

Communications

By submitting the quiz you agree we may contact you by email or phone about your program-fit result and the training program. Marketing messages are optional and you can opt out at any time by following the unsubscribe instructions in a message or by contacting us.

Limitation of liability

To the fullest extent permitted by law, the Services are provided "as is" without warranties of any kind, express or implied. Pimstone Performance and its owners, coaches, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, loss, or damage arising from your use of the Services or participation in any training program. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, in the 12 months before the claim arose.

Indemnification

You agree to indemnify and hold harmless Pimstone Performance from any claims, losses, or expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Services.

Termination

We may suspend or end your access to the Services at any time if you violate these Terms or use the Services in a way that could harm us or others. Sections that by their nature should survive termination will survive.

Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page shows when they were last revised. Continuing to use the Services after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the jurisdiction in which Pimstone Performance is established, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of that jurisdiction unless applicable law gives you the right to bring a claim elsewhere.
